By Agisting your Stock at Chittering Gully Stud you consent and agree to the following
LEGAL
All agistees of Chittering Gully Stud must read agree and adhere to these rules and guidelines set out by Chittering Gully Stud as part of the Agistment agreement made between both parties to ensure everyones time at Chittering Gully Stud is a safe and without incident.
It is a requirement that all agistees at Chittering Gully Stud have signed this “Stock Agistment Contract" before bringing stock on to the property. If you do not comprehend the wording of these documents, then you must seek professional advice.
The stock are at the owners risk at all times. It is the owners responsibility to insure their stock and any progeny against all risks while they are at the agistment property or being transported to or from the property.
AGISTMENT FEES
All agistment fees are payable 4 weeks in advance. Agistment is calculated daily but for the purpose of payment it is calculated in 1 week increments. That is if your stock arrive on a Friday, your week ends on the following Thursday. Money needs to be paid each 4 weeks on the day your week ends. You are responsible for a full days agistment regardless of whether your stock arrive or leave morning or afternoon.
Your agistment fees are those that are agreed upon with yourself, the stock owner and us, Chittering Gully Stud, the landholder. The agistment fees cover the cost of the paddocks, and use of our facilities.
Payment of Agistment fees can made by cash, cheque or direct deposit to our Bank account, please ask us for our bank details. If paying by cheque, please make cheques payable to "Chittering Gully Stud”.
We endeavour to look after your stock as if they were our own and therefore we offer a first class service to all of our clients. We therefore expect you to respond to agistment accounts in a responsible manner.
DEFAULT OF PAYMENT

Failure to meet our trading terms will result in the stock being removed from the property to the pound or to a sale to recover any outstanding agistment. You will be notified before this will happen, so you can rectify the situation.

Stock must not be removed from Chittering Gully Stud’s property until all fees owing are paid in full.

Under the Impounding of Livestock Act 1994 (Updated January 2006), it provides landholders with a legal process and means of recovering agistment expenses where payments are in default.
LEAVING THE PROPERTY
Chittering Gully Stud requires a 4 weeks notifying period if you wish to move your stock from the property.
If you are asked to leave Chittering Gully Stud with your stock for any reason, you will have 7 days from when notice is given, to vacate the property.
RISK OF LOSS:
While your stock is agisted at Chittering Gully Stud, Chittering Gully Stud shall NOT be liable for any sickness, disease, injury or death suffered by the stock or any other cause of action arising from or connecting to the agisting of your stock. All reasonable and proper care of the property is taken by Chittering Gully Stud, but all risks are assumed by the owner of the stock. The owner agrees to hold Chittering Gully Stud harmless from any loss or injury to the agisted stock. All costs, connected with agisting are borne by the stock owner.
Chittering Gully Stud will not remove agisted stock from the property without the stock owners consent, except where the stock is being sold to cover costs by Chittering Gully Stud , or there is an emergency (for example, fire or flood). In this case Chittering Gully Stud will promptly inform the stock owner of the new location of the stock.
DAMAGE TO PROPERTY / FENCES
Chittering Gully Stud expects to do normal maintenance fencing, however, if your stock causes any major damage to the property either intentional or unintentional you as the stock owner are liable for this damage and will be invoiced accordingly for the damage that has occurred.
